We understand that you value your privacy.  This Privacy Policy explains how PlanComparison (“Company,” “we,” or “us”) collects, uses, shares, and protects information of the users of Company’s Service.  Words capitalized in this Privacy Policy have the same definition as provided in the Terms of Service.  By using or accessing the Service, you signify your agreement to this Privacy Policy and the Terms of Service and agree you are a U.S. resident over 18 years of age; if you do not agree, you must not use or access the Service.

Company helps connect consumers with third-party Providers, such as insurance companies and agents.  By submitting a Request Form for an insurance quote or comparison, or contacting us, you expressly authorize us to share your information with third parties, including Providers, who may contact or communicate with you about your request or to obtain further information.  This Privacy Policy only applies to PlanComparison’s Service and not to websites, applications, platforms, or services of third parties, such as third-party Providers.  Each third party will have its own data collection and usage practices, and Company is not responsible for any third-party practices or content.

This Policy applies to our offline and online data collection practices, including when you visit our website at www.plancomparison.co or the websites of any of our affiliates (collectively the “Site”), inquire about our Service or when you engage or communicate with us via email or other methods.

We may update this Policy from time to time, as specified in the “How will you know when we change this Privacy Policy?” section below.

California state law confers certain rights relating to personal information to its residents.  If you are a California resident, please also see our California Consumer Privacy Section in this Policy located at: California Users.

Your Consent

Please review this Policy periodically.  You should read this entire Policy before submitting information, including personal information, to us in any form or using our Site.  Whenever you submit personal information to us, you consent to the collection, use, disclosure, share, sale, transfer, and storage of that information in accordance with this Policy.

All personal information may be used for the purposes stated in this Policy.  We may make full use of all information that is de-identified, aggregated, or otherwise not in personally identifiable form.

  1. What types of information are collected?

We collect personal information using three methods: 1) from you when you choose to voluntarily provide it; 2) using automated technology, including when you visit our Site or communicate with us through email; and 3) through third party sources including but not limited to service providers, entities providing data analysis and analytics, social media and social networking websites and other entities.

All personal information will be used as stated in this Policy.  To see a complete list of what we collect and how we use this data, see Annex 1.

As part of its Service, Company collects the following “information” (i.e., personal information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular user or household):

  • Personal Identifiers. We collect personal identifiers, such as your name, email address, postal address, phone number, date of birth, desired plan type, whether you smoke, and whether you have major medical conditions.  Note that third-party Providers or their agents may also ask you to voluntarily provide other information, including certain personal health information, such as any major health conditions, prescription medications that you or a family member may be taking, whether or not you have been hospitalized in the past 5 years, and whether or not you have been treated by a doctor for a major health condition in the past year.
  • Device/Internet Connection Information. We automatically collect information made available by your device, web browser, and internet service provider, depending on your settings for each.  For example, we may collect your IP address, information about your operating system or type of device, unique device identifiers, access times and dates, number of clicks, pages viewed, one or more cookies (as described below) that may uniquely identify your browser, and referring website addresses.
  • Internet Activity Information. We may collect information about your browsing history, search history, and information regarding your interaction with a particular website, application, or advertisement, including the Service, when and after you use the Service.  We may record you user sessions and interactions with our website, directly or through our Service Providers.
  • Geolocation Information. We may collect information about where you are located, both generally and at the time you access the Service, such as from your IP address.
  1. When and how is your information collected?

Company collects information about you through the following sources and means:

  • When You Provide Information. Company collects information you provide, content you make public, transaction information, geolocation information, and other information when you provide such information through or interact with the Service.  For example, when you submit a Request Form, we collect information pertinent to connect you with Providers.
  • Through Communications. Company may collect information you provide via email, the Website, phone or other methods, content you make public, transaction information, geolocation information, and other information outside of the Service, such as if you contact customer service.
  • Through Cookies, Tracking Tools, and Other Automated Technologies
  • Session Recording. When you visit our website or access or use the Service, your user sessions and interactions may be recorded by us and/or our Service Providers.
  • Other Information. We may combine data collected from third party sources.
  • From Third-Party Automated Technologies. Like many websites, Company collects transaction information, device/internet connection information, internet activity information, geolocation information, and other information from third-party cookies, tracking tools, and other automated technologies, such as through the following:

  1. How is your information used?

Company uses personal information for the following “Business Purposes” (i.e., uses reasonably necessary and proportionate to achieve an operational purpose):

  • To Provide the Service. We use information to provide the Service, such as to display customized content and advertising and to connect you with third-party Providers, who may contact you to provide your requested quote and related information.  As outlined in the Terms of Service, by seeking information through the Service, you authorize Company and third-party Providers to contact and communicate with you, including over email and telephone.  Further, as we grow, we may add offerings and use and analyze your information to determine whether such offerings may be of interest to you.
  • To Improve the Service, Business and Company Website. We use information to improve the Service, such as to debug, identify, and repair errors that impair functionality of the Service, and to gather statistical information for analytics and to improve performance via technological development.
  • To Personalize Your Experience. We use information, such as from cookies and automated technologies, to allow you to set personal preferences.
  • To Communicate with You. We use information to personalize communications with you, respond to requests and inquiries, follow up with you after you have communicated with us or submitted information to us via email, website or using other means, send you newsletters (if you subscribe) and information that may be of interest to you, and notify you of updates to our Terms of Service and Privacy Policy.
  • For Sweepstakes and Promotions. From time to time, you may be given the opportunity to participate in sweepstakes, contests, giveaways, or other promotions and programs offered by us, either alone or with promotional partners.  Such participation may request your information.
  • For Security. We use information to detect security incidents, protect against malicious, fraudulent, or illegal activity, and to investigate those responsible.  If we learn of a security breach, we may use your information to notify you.
  • To Create Deidentified Aggregate Information. We may combine your information with that of other users to create “Aggregate Information” (statistical information about all users or a subset thereof).  Aggregate Information is pseudonymized and deidentified and is not used to identify, relate to, describe, be capable of being associated with, or be linked, directly or indirectly, to a particular consumer, including you.  In turn, Aggregate Information may be used by Company for any of the Purposes listed herein.

Company uses personal information for the following “Commercial Purposes” (i.e., uses intended to advance Company’s business interests, such as advertising or marketing a product or service):

  • To Advertise to You. We use information, such as information collected through cookies and automated technologies, for marketing, analytics and profiling technology to customize your experience, statistical purposes, deliver content (including advertising) tailored to your interests and how you use our Services, to market to you through targeted advertising.
  • To Advertise to Others. We may share your public content, such as a public post, review, or blog post, to market our Service in our advertising, such as on social media.
  • For Research and Legal Purposes. We use your information for marketing, research and legal purposes.

We use your information as otherwise specified at the point of personal information collection.

  1. How is your information disclosed?

Company may share the information outlined in Section 2 to the following categories of third parties for the following Purposes:

Government Officials and Private Parties Pursuant to Valid Legal Process. OPT-OUT OF SALE OR SHARING OF PERSONAL INFORMATION

You may opt-out of the sale or sharing of your personal information by:

  1. How is your information protected?

Company employs technical, administrative, and physical security measures that are designed to protect against the loss, misuse, and alteration of the information under our control.  For example, if you enter sensitive information into a Request Form seeking such information, we encrypt that information using secure socket layer technology (SSL).  However, no system can be completely secure.  Therefore, although we take steps to secure your information, we cannot promise, and you should not expect, that your personal and commercial information will always remain secure.  The safety and security of your information also depends on you.  You must notify us as soon as possible if you believe your security has been breached.  Users are also responsible for any information provided on the Service.  If a security breach does occur, we may post a notice on our Service or send you a notification to your email address or address on record.  If you have any questions about privacy or security issues, contact us as outlined in Section 13.

  1. How long do we keep your information?

We will retain your personal information (collected through offline and online methods) for as long as it is necessary for the purposes described in this Policy.  We will also retain and use your personal information to the extent necessary to comply with our legal obligations, resolve disputes, and enforce our legal agreements and policies.  For more information regarding retention of personal information see Annex 1.

  1. Is your information transferred to a different country?

Your connection will be through and to servers located in the United States and Canada, and all information you provide will be processed and maintained in our web servers and internal systems located within the United States and Canada.  By using the Service, you authorize and specifically consent to the transfer of personal information to the United States and Canada and its storage and use as specified herein.

  1. What are your rights when it comes to accessing, correcting, or deleting your information, and how can you exercise them?

Under certain privacy legislation, you may request to know, delete, and opt-out of the sale of your personal information. These requests can be made by emailing Company at marketing@pathiq.co We will not discriminate against you for making a privacy request or asserting privacy rights.

To protect your privacy and security, we take reasonable steps to help verify your identity before granting your request. Once we receive your Request, we will begin the process to verify that you are the person that is the subject of the request (the “Verification Process”). The Verification Process consists of matching identifying information provided by you with the information we have about you in our records. Upon making a request, you should be prepared to provide us with information that will help us to verify your identification. If we cannot verify your identity, we will not be able to respond to your request.

We reserve the right to deny requests in certain circumstances, such as where we have a reasonable belief that the request is fraudulent.

Please note that in some cases it may be necessary for you to contact other third parties who may have received your information and separately request updates to or deletions of your information. In particular, you may be authorized to make the following requests:

  • Right to Know

You have the right to request that we disclose the following to you: the categories of personal information we have collected about you; the categories of sources from which the personal information is collected; the business or commercial purpose for collecting or selling personal information; the categories of third parties with whom we share personal information; and the specific pieces of personal information we have collected about you.

You also have a right to know if we have sold or disclosed your personal information for a business purpose over the past 12 months and, if so, the categories of personal information sold or disclosed and the categories of third parties to whom the personal information was sold or disclosed, along with the business or commercial purpose for which the personal information was sold or disclosed.

Information Collected. Within the past 12 months, we have collected categories of Personal Information about consumers as described in Section 2.

Information Sold or Disclosed.

We have sold or shared personal information to third parties for a business or commercial purpose in the preceding 12 months as follows:

Other than as set forth above, we have not disclosed personal information for a business or commercial purpose in the preceding 12 months.

We do not knowingly sell the personal information of individuals under 16 years of age.

  • Right to Delete

You have the right to request that we delete any personal information about you.

We will retain correspondence, documents and information related to any Request to Know, Request to Delete, or Request to Opt-Out for 24 months as required by law.

  • RIGHT TO OPT-OUT OF SELLING OR SHARING OF PERSONAL INFORMATION

As explained in Section 3 of this Policy, we and our third-party partners such as social networking sites and advertising companies, share your data in order to serve you with ads tailored to your preferences across various platforms.

You have the right, at any time, to direct Company not to sell your information. You may do so by filling out a Do Not Sell My Personal Information request in the form at PlanComparison.

You can opt out of cookies using your browser. Additionally, you may also exercise your right to opt-out of cookies and automated technology used by Company and third party partners using the opt-out methods identified in Section 3.

Please Note:

  • Opt-outs are device and browser based. You must opt out on each device and each browser where you want your choice to apply.
  • Opt-outs maybe stored via cookies. If you clear cookies, your opt-out may no longer be valid and you must opt out again where you want your choices to apply.
  • We may still share your Personal Information with our service providers that help us perform functions that are necessary for our business such as vendors that host our Site, analytics processors, etc. These entities are contractually obligated to keep this information confidential and not use it for any purpose other than for the services they provide to our business.
  • You may still receive ads from us that are not tailored to your interests.
  1. How do we protect the privacy of children?

You must be 18 or older to use the Service.  We will never knowingly collect any personal information about children under the age of 13.  If we obtain actual knowledge that we have collected personal information about a child under the age of 13, that information will be deleted from our database.  Because we do not collect such information, we have no such information to use or to disclose to third parties.  We have designed this policy in order to comply with the Children’s Online Privacy Protection Act (COPPA).

  1. What about external links?

We may make available third party applications through our Site applications for your use.  Links to such applications, any other websites included in this Site or links on our social media accounts operate with privacy policies beyond our control.  Unless otherwise indicated, once you have left our Site or our social media account, all use of information you provide is governed by the privacy policy of the other website’s or social media account’s operators.  We are not responsible for any transactions that occur between you and a third-party website or social media account.

  1. What law governs this Policy?

This Policy and our privacy policies shall be governed by and construed in accordance with the Arbitration Act (Ontario) and the laws of the province of Ontario, exclusive of conflict or choice of law rules.

  1. How will you know when we change this Privacy Policy?

Each time you use the Service, the then-current version of this Privacy Policy will apply.  Although most changes are likely to be minor, we reserve the right to modify this Privacy Policy by posting such modification on the Service.  Unless we receive your express consent, any revised Privacy Policy will apply only to information collected after the effective date of such revised Privacy Policy and not to information collected under any earlier version.

CALIFORNIA CONSUMERS ONLY:  Your California Privacy Rights

This Privacy Rights Act Notice (“Notice”) provides additional information to California residents whose Personal Information is collected by us pursuant to California law, including the California Consumer Privacy Act (“CCPA”), as amended by the California Privacy Rights Act (“CPRA”).  If you are not a California resident, this Notice does not apply to you. RIGHT TO KNOW ABOUT PERSONAL INFORMATION COLLECTED, DISCLOSED, OR SOLD AND SHARED

Information Collected 

Within the past 12 months, we have collected the categories of personal information about California consumers as described in Annex 1 to this Notice.  To review these categories click here.

Business-to-Business (“B2B”) Information

If you are a contact person for any of our business partners, vendors, distributors, suppliers, service providers, contractors, or other entities with which we have a business relationship or potential business relationship, we collect the contact information you provide to us, including name, phone number, address, email address and other contact and relationship information consistent with your role in facilitating that business relationship.  We use that information for internal purposes, including to contact you, send and receive information, and otherwise facilitate the business relationship.  We do not disclose that information outside our business relationship without your consent.

Information Sold or Shared

As explained in Annex 1 of this Policy, we share your data with third-party partners such as social networking sites and advertising companies in order to serve you with ads tailored to your preferences across various platforms.  This type of sharing may be considered “selling” or “sharing” under the CPRA.  You can control the information shared about you and request an opt-out as explained below.

We have sold or shared the following categories of personal information for a business or commercial purpose in the preceding 12 months.

  • Identifiers
  • Content You Make Public
  • Device/Internet Connection Information
  • Internet Activity Information

Except as set forth above, we have not disclosed personal information for a business or commercial purpose in the preceding 12 months.

We do not knowingly sell the personal information of individuals under 16 years of age without affirmative authorization.

Requests to Know

You have the right to request that we disclose personal information we collect about you.

To make a request for any of the information set forth above (a “Request to Know”), please submit a verifiable consumer request pursuant to the instructions below.  You may only make a Request to Know twice within a 12-month period.  We will acknowledge your Request to Know within 10 days and will attempt to respond substantively within 45-90 days.

The Request to Know must provide sufficient information to allow us to verify that you are the person about whom the personal information was collected, sold or disclosed and must contain sufficient detail to allow us to properly understand, evaluate and respond to your request.  If we cannot verify your identity, we will not be able to respond to your request.

Once we receive your Request to Know, we will begin the process to verify that you are the person that is the subject of the request (the “Verification Process”).  The Verification Process consists of matching identifying information provided by you with the information we have about you in our records. If you are an account holder, making a request through your account is sufficient for verification purposes.  If you do not have an account with us, you will be asked to provide us with two or three pieces of information that will help us to verify your identification.

RIGHT TO KNOW AND LIMIT USE OF SENSITIVE PERSONAL INFORMATION COLLECTED

We do not collect your Sensitive Personal Information for purposes of inferring characteristics or for any purposes other than those set forth in Regulations Section 7027(m).

RIGHT TO REQUEST DELETION OF PERSONAL INFORMATION

You have the right to request the deletion of your personal information collected or maintained by us (“Request to Delete”), subject to certain exceptions permitted by law.

To make a Request to Delete, please submit a verifiable consumer request pursuant to the instructions below. We will acknowledge your Request to Delete within 10 days and will attempt to respond substantively within 45-90 days.

The Request to Delete must provide sufficient information to allow us to verify that you are the person about whom the personal information was collected, sold or disclosed and must contain sufficient detail to allow us to properly understand, evaluate and respond to your request.  If we cannot verify your identity, we will not be able to respond to your request.  Additionally, as permitted by law, if the information requested to be deleted is necessary for us to maintain, we will not be able to comply with your request.  We will notify you if this is the case.

Once we receive your initial request to delete and your separate confirmation to delete, we will need to verify that you are the person that is the subject of the request (the “Verification Process”).  The Verification Process consists of matching identifying information provided by you with the information we have about you in our records.

We will retain correspondence, documents and information related to any Request to Know, Request to Delete, or Request to Opt-Out for 24 months as required by law.

RIGHT TO OPT-OUT OF SALE OR SHARING OF PERSONAL INFORMATION

You have the right to opt-out of the sale or sharing of your Personal Information.  As explained in Annex 1 of this Policy, we share your data with third parties such as social networking sites and advertising companies, in order to serve you with ads tailored to your preferences across various platforms, and to connect you with third-party Providers, who may contact you to provide your requested quote and related information.  This type of sharing may be considered “selling” or “sharing” under the CPRA.  You can control the information shared about you and request an opt-out as explained below. We will process your Request to Opt-Out of sale within 15 days.

In addition to the above options to opt out of the sale or sharing of your information under the CCPA as described above, you have controls and choices with respect to collection and use of your information by third parties.  These are summarized for you below.  We do not control or maintain opt-out mechanisms for third-party companies and are not responsible for their operation.

CALIFORNIA DO NOT TRACK NOTICE

DNT is a feature offered by some browsers which, when enabled, sends a signal to websites to request that your browsing is not tracked.  Company does not currently respond to DNT requests.

CALIFORNIA SHINE THE LIGHT DISCLOSURE INFORMATION

Although we do not disclose to any third-parties for their marketing purposes any personal information, California residents are entitled to receive the following disclosure information under California law:
